Terms & Conditions

By using the Renovation Choice website, you accept these terms and conditions ("Agreement") and our Privacy Policy. This Agreement is between you and Renovation Choice (Renovation Choice Group Pty Ltd) (referred to in this Agreement as "we", "us" or "our"). We have the right to change these terms and conditions and the changed terms will be posted on this website. If you continue to use this website, you agree to be bound by these changes.

Prices, Payments, Discounts and Interest

1.Prices of goods, delivery and other charges shown are in Australian dollars.

2.Prices are those contained in Renovation Choice’s published prices list, and include GST, and are subject to change at any time without further notice.

3.All payments must be received in full prior to dispatch of goods or a voucher being issued. If your payment is not received or is declined by us, your bank or credit card issuer, we cannot and will not hold items against your order.

4.An amount outstanding to Renovation Choice will be subject to interest on the overdue amount calculated at the rate of ten per cent (10%) per annum.

5.In the event that the Customer fails to pay for Goods in accordance with these Terms, the Customer must, if requested, return the Goods to Renovation Choice at the Customer's cost.

Disclaimer and Liability

6.To the fullest extent possible at law, we exclude all liability to you or anyone else for loss or damage of any kind or nature relating in any way to the Website including, but not limited to, loss or damage you might suffer as a result of:

6.1.errors, mistakes or inaccuracies on the Website or our social media pages;

6.2.you acting or not acting, on any information contained on or referred to on the Website and/or any linked Website or our social media pages;

6.3.personal injury or property damage of any nature resulting from your access to or use of the Website;

6.4.any unauthorized access to or use of our secure servers and/or personal information and/or financial information stored on those servers;

6.5.any interruption or cessation of transmission to or from the Website;

6.6.any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through our Website by any third party; and/or

6.7.the quality of any product or service of any linked sites.

7.We do not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through the Website or any linked Website or featured in any banner or other advertising. We will not be a party to or in any way responsible for monitoring any transaction between you and third party merchants of goods and services.

8.Where any law (including the Australian Consumer Law) provides a guarantee which may not be lawfully excluded, our liability will be limited to that provided by law.

9.Except as required by law, in no event shall we, our affiliates and related entities or our suppliers be liable for any loss or any special, incidental or consequential damages arising out of or in connection with our Website or this Agreement (however arising, including negligence). You agree to accept sole responsibility for the legality of your actions under the laws that apply to you. You agree that we, our affiliates and related entities or our suppliers have no responsibility for the legality of your actions.

10.It shall be your responsibility to make all necessary enquiries and take any action you consider necessary if you require insurance or require the service merchant to be insured or to have insurance coverage that covers you in respect of the provision of their goods and services, prior to proceeding with any booking or services. Renovation Choice accepts no liability in this regard.

Delivery and inspection

  1. If the Customer wishes to change the delivery details, Renovation Choice must be notified at least one (1) working day prior to the scheduled delivery date.
  2. The Customer must ensure that the goods are accepted at the designated delivery address on the scheduled delivery date. In order to guarantee receipt of the goods, Renovation Choice's contract carrier will contact the Customer prior to delivery with an approximate delivery time.
  3. The delivery dates and times provided by Renovation Choice are only estimates.
  4. Renovation Choice will not be liable for any loss, damage or liability suffered by the Customer as a result of failure to supply the goods by a specific date or time, the Customer will pay Renovation Choice an additional delivery charge for any costs incurred as a result of the non-delivery of the goods. Renovation Choice may, in its sole and absolute discretion, suspend or cancel delivery if the Customer is late in making any payment to Renovation Choice or is in breach of these Terms.
  5. The Customer must upon delivery, notify Renovation Choice of any damage to Goods which are otherwise inconsistent with the Customer's order. Failing such notice, and to the extent permitted by law, the Customer will otherwise be deemed to have accepted the Goods.

Returns and Refunds

  1. All Goods of faulty manufacture will be credited or replaced for inspection and return. To the extent permitted by the Trade Practices Act and other relevant legislation, the Renovation Choice’s liability is limited to: The cost of replacing the goods; The cost of obtaining equivalent goods; The cost of having the goods repaired.
  2. Once an item is returned we will either inspect your goods and investigate any claimed defect or, where we believe it is applicable, provide a remedy in relation to your goods. If we do no believe a remedy is applicable upon inspecting your goods (for example, where we believe the goods have been misused, or there was a failure to use in accordance with manufacturer's instructions, used it in an abnormal way or there has been a failure to take reasonable care), we will reject your claim and return your goods to you. You must cover the cost of return shipping in order to receive goods we have rejected on inspection, and we will provide you with instructions on how to make this payment.
  3. Renovation Choice shall not be liable for damage to or shortage of products unless written notice is received within two (2) working days of receipt or delivery.

Change of Mind Returns

  1. The Company will allow a return for a refund or store credit or exchange product where the Customer has changed the mind, provided that the item in question is: (1) returned within 14 days of receiving the order; (2) as new and is not used or installed, and has all original packaging and tags in-tac; (3) in a resalable condition; (4) not damaged in any way.
  2. Certain goods (including special orders and discontinued items) ordered for the Customer are irrevocable, except where the Company agrees to the contrary.
  3. The Company cannot accept change of mind returns on goods that come in sealed packages or boxes where seals or boxes are damaged or broken.
  4. If the returned item does not meet the conditions of the return policy, the Customer will be responsible for the cost of receiving the return goods back to the nominated address.
  5. If we allow a return in these circumstances, we will ask you to follow our returns process.
  6. We may provide you with a product exchange when we receive the returned product. You are responsible for payment of return postage on your order. Change of mind returns are not accepted for large bulky goods such as shower screens or bathtubs. Under no circumstances will custom made products be accepted for returns. Remedies for defective goods are still available. 
  7. A 20% (whichever is lower) re-stocking and returns handling fee will apply to returns accepted under this clause.

Title

  1. Title to the goods will remain with Renovation Choice and will not pass to the Customer until the Customer has paid all amounts owed to Renovation Choice by the Customer on any account.
  2. If the Customer sells the Goods contrary to Renovation Choice's title without prior payment of all amounts owing to Renovation Choice, the Customer must hold the proceeds of such sale as trustee for Renovation Choice. Renovation Choice will be entitled to recover all proceeds held on trust and the Customer agrees to bear the costs of such recovery action.
  3. The risk of loss or damage to the Goods will pass to the Customer on delivery.

Unforeseen Events

  1. Renovation Choice may cancel or suspend delivery of any ordered Goods in the event of any delay or non-performance due directly or indirectly to war, terrorism, strike, lockout, delay or default of a manufacturer or supplier, act of God, or any other cause beyond Renovation Choice's reasonable control. 

Variation

  1. The Contract cannot be varied unless Renovation Choice agrees in writing with the Customer to vary it.
